HRACRE opposes legislation that endangers the sovereignty of private property. Owners have a constitutional right to determine the use of their land, within guidelines established by local government, and should not have those compromised because localities fail to use legitimate laws already at their disposal. .
Indeed HRACRE members contend that cities and counties can manage their infrastructure needs through wise and reasoned consideration of individual zoning requests coupled with a coherent capital improvements program. Any attempt to deny building permits to legally zoned property based on the absence of public facilities is an infringement on vested rights and results in a rationing of development. Further the possession of such powers by a municipality impacts the market supply of developed property, skews prices for that property and removes the incentive for local government to adequately plan and fund public infrastructure.
